Introduction Below you will find our Terms and Conditions. These apply whenever you use or place an order through our Website. The General Terms and Conditions contain important information for you as a buyer. Therefore, read it carefully. We also recommend that you save or print these terms and conditions so that you can read them again at a later time.

Article 1. Definitions1.1. BKRS Crane Systems BV: established in Veghel and registered with the Chamber of Commerce under registration number 17226694, trading under the name BKRS Crane Systems B.V.1.2. Website: the website of BKRS Crane Systems B.V., which can be consulted via https://bkrs.nl/ and all associated subdomains.1.3. Customer: the customer who, whether or not acting in the exercise of a profession or business, enters into an Agreement with BKRS Crane Systems B.V. and/or has registered on the Website.1.4. Agreement: any agreement or agreement between BKRS Crane Systems B.V. and the Client, of which the General Terms and Conditions form an integral part.1.5. General Terms and Conditions: the present General Terms and Conditions.

Article 2. Applicability of General Terms and Conditions2.1. The General Terms and Conditions apply to all offers, Agreements and deliveries of BKRS Crane Systems B.V., unless expressly agreed otherwise in writing.2.2. If the Client includes provisions or conditions in its order, confirmation or notification containing acceptance that deviate from, or do not appear in the General Terms and Conditions, these are only binding on BKRS Crane Systems B.V. if and insofar as they have been expressly accepted by BKRS Crane Systems B.V. in writing.2.3. In the event that specific product or service terms and conditions apply in addition to these General Terms and Conditions, those terms and conditions also apply, but in the event of conflicting conditions, the Customer can always invoke the applicable provision that is most favourable to it.

Article 3. Prices and information3.1. All prices stated on the Website and in other materials originating from BKRS Crane Systems B.V. are exclusive of VAT and, unless otherwise stated on the Website, other levies imposed by the government.3.2. If shipping costs are charged, this will be clearly stated in good time before the conclusion of the Agreement. In addition, these costs will be displayed separately in the ordering process.3.3. The content of the Website has been compiled with the greatest care. However, BKRS Crane Systems B.V. cannot guarantee that all information on the Website is correct and complete at all times. All prices and other information on the Website and in other materials originating from BKRS Crane Systems B.V. are therefore subject to obvious programming and typing errors.3.4. BKRS Crane Systems B.V. cannot be held responsible for (color) deviations as a result of screen quality.

Article 4. Conclusion of the agreement4.1. The Agreement is concluded at the time of acceptance by the Client of the offer of BKRS Crane Systems B.V. and the fulfilment of the conditions set by BKRS Crane Systems B.V.4.2. If the Client has accepted the offer electronically, BKRS Crane Systems B.V. will immediately confirm receipt of the acceptance of the offer by electronic means. As long as the receipt of this acceptance has not been confirmed, the Client has the option to terminate the Agreement.4.3. If it appears that incorrect information was provided by the Client at the time of acceptance or otherwise entering into the Agreement, BKRS Crane Systems B.V. has the right to comply with its obligation only after the correct information has been received.4.4. BKRS Crane Systems B.V. can inform itself within legal frameworks whether the Client can meet its payment obligations, but also of all facts and factors that are important for a responsible conclusion of the Agreement. If, on the basis of this investigation, BKRS Crane Systems B.V. has good grounds for not entering into the Agreement, it is entitled to refuse an order or request with reasons or to attach special conditions, such as advance payment, to the execution.

Article 5. Execution of the agreement5.1. As soon as the order has been received by BKRS Crane Systems B.V., BKRS Crane Systems B.V. will send the products as soon as possible, taking into account the provisions of paragraph 3 of this Article.5.2. BKRS Crane Systems B.V. is entitled to engage third parties in the performance of the obligations arising from the Agreement.5.3. An indication of the delivery time is indicated via the Website. If items are in stock, they will be shipped the same working day or no later than the working day after. The method of delivery can take place in different ways and is at the discretion of BKRS Crane Systems B.V.. 5.4. If BKRS Crane Systems B.V. is unable to deliver the products within the agreed period, it will notify the Client thereof. In that case, the Client can agree to a new delivery date or he will be given the opportunity to dissolve the Agreement free of charge.5.5. BKRS Crane Systems B.V. advises the Customer to inspect the delivered products and to report the defects found within 24 hours, preferably in writing. See the Article on warranty and conformity for more details.5.6. As soon as the products to be delivered have been delivered to the specified delivery address, the risk, as far as these products are concerned, is transferred to the Customer. If expressly agreed otherwise, the risk will be transferred to the Client earlier. If the Customer decides to collect the products, the risk will pass upon transfer of the products.5.7. BKRS Crane Systems B.V. is entitled to supply a similar product of similar quality to the ordered product, if the ordered product is no longer available. The Customer is then entitled to terminate the Agreement free of charge and to return the product free of charge.
